What prior authority is
Prior authority is advance approval from the Legal Aid Agency to incur a disbursement, such as an expert’s fee. It gives confidence that the cost will be allowed on assessment.
When to apply
Apply where the expert’s rate or hours are above what would normally be allowed, or where the cost is significant. Applying early protects the court timetable.
What to include
- Why the evidence is necessary
- The expert’s discipline, hourly rate and estimated hours
- Travel and prison visit time
- Total estimated cost
How we help
Every quote we send is itemised in this format, so it can go straight into your application. We hold the expert’s provisional dates while you wait for a decision.
Always check current Legal Aid Agency guidance before applying.
