When to instruct
Some cases turn on a medical question outside psychiatry and general practice. A consultant physician can explain how a condition such as diabetes, heart disease or a sleep disorder may have affected the defendant, and whether they are fit to attend court or be detained.
Examples
- Hypoglycaemia and the defence of automatism
- Effects of medication on behaviour or driving
- Fitness to attend court, give evidence or be detained
- Prognosis of a serious illness relevant to sentence
Children and young people
Where a case involves a child or young person, a consultant paediatrician can give evidence on medical matters, development and injuries, with an understanding of the different needs of young defendants and witnesses.
